Dear Kim,
My grandmother passed away and left a small estate. I recently found out that her will stated that if her children died before her, then that portion of her estate would go to the grandchild (which is me). I want to use this money (about $50,000) for my daughter’s college education, but I also know that my stepmother feels that she is entitled to some of this money, too. What do you advise for my next steps?
Sincerely,
Family Inheritance Issues
Dear Family Inheritance Issues,
I’m assuming your father, the child of your grandmother, has passed, and I’m sorry for your loss.
Regarding your grandmother’s estate — Is your stepmother somehow related to your grandmother? And was your stepmother named in your grandmother’s will? If the answer to both of those questions is no, then I don’t believe she has any claim to the money your grandmother left.
I would have the conversation with your stepmother, clarifying why she believes she is entitled to part of those funds, and kindly explain to her what your plans are for the money. Hopefully, she will understand, and your relationship with her can continue.
Kim
